Rental Agreement

This Rental Policy (the "Rental Policy") includes the terms and conditions which govern (a) reservations for SuperCar Experience LLC rental vehicles ("SuperCar," "we," or "us") and (b) rentals of vehicles using such reservations (together the "Reservation Terms"). "You" or "yours" means the person identified as the renter on the reservation, any person signing or otherwise agreeing to this Rental Policy, any Authorized Driver and any person or organization to whom charges are billed by us at your direction.

These Reservation Terms apply in combination with any other terms, agreements, or policies you may receive from us. A copy may be emailed to you at the email address provided to us in the process of reserving your rental vehicle.

To reserve and rent a vehicle from us, you must meet the following eligibility requirements:

• Be at least 21 years of age (renters under 25 years of age may be subject to additional fees or restrictions pursuant to Nevada, California, Arizona, Idaho, New York, Utah, Florida and Washington DC law);
• Possess a driver's license with a photo that is valid for the entire rental period, present at time of vehicle pick up;
• Provide a valid debit or credit card in your name for the security deposit and rental charges (or any other form of payment explicitly approved by SuperCar); and
• Provide proof of insurance that meets or exceeds the minimum coverage requirements as specified herein and by the laws of the state of the rental, which shall be limited to Nevada, California, Arizona, Idaho, New York, Utah, Florida or Washington DC, based on the terms of the rental agreement.

To rent a vehicle from us, you must do the following:

• Visit our reservation page.
• Type in the location you want to pick up/return your vehicle.
• Enter your departure date and return date. Then select "Check Availability."
• Next, choose the vehicle you want to rent.
• Add any additional items to your rental.
• Review your reservation, add in your contact information and confirm your reservation by clicking "Confirm Booking."

You can also rent a vehicle in person at our location.

The rates and fees applicable to the vehicle rental and reservation are detailed below.

Base Rental Rate. The base rate for renting a vehicle, which is determined based on the type of vehicle selected, the duration of the rental period, and the mileage included. The specific rate will be disclosed at the time of rental.

Insurance Costs. Optional insurance coverage is available at an additional cost. The Renter must provide full coverage insurance during the rental period.

Additional Driver Fees. You are the only driver allowed to operate the vehicle. If you wish to add additional drivers to the rental, a per-day fee will be charged for each additional driver. The specific rate will be disclosed at the time of rental.

Cleaning Fees. We add reasonable fees to clean the vehicle. The specific rate will be disclosed at the time of rental.

Drop Fee. If you do not return the vehicle to the same location as rented, then we add a Drop Off fee plus our out-of-pocket recovery costs, if any.

Late Return Fees. Returning the car after the agreed-upon return time will result in additional charges. The specific rate will be disclosed at the time of rental.

Refueling Fees. You have the option to: (1) prepay for the fuel at the time of rental and return the tank empty; (2) pay at the end of the rental for fuel used but not replaced; or (3) return the vehicle with the same amount of fuel as received to avoid extra fuel charges. You will not be issued a refund for unused fuel. You must use the exact fuel as directed by us or be subject to additional charges.

Additional Charges. Any other fees or charges not specifically mentioned herein will be disclosed at the time of rental.

All rates and fees are subject to change without notice and are subject to the laws and regulations of the State of Nevada, California, Arizona, Idaho, New York, Utah, Florida and Washington DC. You agree to pay all fees associated with the rental of the vehicle as specified in this Policy or elsewhere. Payment shall be made in full at the time of vehicle pickup, unless otherwise agreed upon in writing by SuperCar. All payments are non-refundable, except as may be expressly provided in this Policy or required by applicable law. You are responsible for any costs arising from damage to the rental vehicle not covered by insurance, as well as any fines or penalties incurred during the rental period. All rates and fees are subject to final audit by SuperCar. If errors in computation are discovered after the close of this rental, you authorize us to correct the Charges with the issuer of the payment card used for this rental.

You are required to provide a security deposit at the time of vehicle pickup ("Security Deposit"). The amount of the Security Deposit will be determined by SuperCar based on the vehicle model, rental duration, and other relevant factors, in SuperCar's sole discretion. The Security Deposit will be immediately withdrawn in full before the rental vehicle can be released to you. The Security Deposit will be held by SuperCar for the duration of the rental period. Upon return of the vehicle, we will inspect the vehicle for damages and assess any additional charges as necessary. If the vehicle is returned in the same condition as at the time of rental, and no additional repair charges are due, the Security Deposit will be refunded to you in full within a reasonable period, not exceeding seven (7) calendar days. Your financial institution may take up to 14 days to process the credit; we are not responsible for fees you incur due to insufficient funds.

In the event that the vehicle is returned with damage(s) or any additional charges are incurred, we will use the Security Deposit to cover such costs. We may use the Security Deposit to pay all amounts owed to us under this Agreement. Any remaining balance of the Security Deposit after deductions for damages or additional charges will be refunded to you. If the costs exceed the amount of the Security Deposit, then you will be responsible for paying the difference. You have the right to request a detailed statement of the damage(s) and additional charges deducted from the Security Deposit. This request must be made in writing within fifteen (15) business days of vehicle return.

The credit, debit, or other acceptable payment card entered and used by you at the time of reservation must be provided at the time of rent for verification purposes but does not have to be used to pay for the rental charges. If a debit card or other payment card that is not a credit card is used to reserve your rental vehicle, you may not be permitted to use the same card to qualify at the time of rental. Debit cards are accepted at all locations as a final form of payment when the vehicle is returned. While a debit card may be used to reserve a rental vehicle without a credit check being performed, if such card is acceptable for use at your rental location and is offered by you for hold or payment purposes, a credit check may be performed.

SuperCar may authorize a security hold on your credit card separate from the Security Deposit. The authorization, or portion thereof, may be used for any additional charges accumulated during the rental period beyond what was already taken for payment at the beginning of the rental. The authorization amount depends on the type of vehicle and other factors.

You agree that SuperCar has the right to recover any charges incurred during the rental period by you. This includes, but is not limited to, toll charges, parking violations, traffic tickets, impound charges, or any other fees that we may have to pay on your behalf. You are responsible for reimbursing SuperCar for these charges, and such amounts may be deducted from your Security Deposit or charged to the payment method on file. You agree to indemnify and hold SuperCar harmless for any such charges or fees incurred.

All cancellations are subject to a maximum refund of 50%. Cancellations made within 7 days of the scheduled rental are eligible for a maximum refund of 25%. Cancellations made within 4 days of the scheduled rental are non-refundable. Due to the specialized nature of the exotic automotive rental industry, these policies are strictly enforced.

In the event of a cancellation or no-show, the payment card provided during your reservation will be charged in the amount shown during the reservation booking process, according to the details provided. The cancellation or no-show amounts and details will also be provided in your confirmation email. If you will be delayed for any reason, please contact us at (888) 678-6077.

Reservations are valid and honored for up to three hours after the requested pick-up time or until the location's regular closing time, whichever is earlier. If the rental vehicle is not picked up within three hours of the requested pick-up time your reservation status will be changed to a NO SHOW. To avoid any problems, please contact us at (888) 678-6077 if you need to change your vehicle pick-up time.

For non-prepaid reservations, we make no guarantee that a specific vehicle will be available at the time of rent. In the event that a vehicle is not available at the time of rent, we will attempt to provide you with a similar vehicle to that which was reserved.

The rental period shall commence at the time you take possession of the vehicle from us and shall terminate when the vehicle is returned to the SuperCar rental office from which you picked up the vehicle. The vehicle must be returned no later than the return time and date specified by SuperCar. Failure to return the vehicle by the specified time may result in additional charges, including but not limited to late fees, additional rental days, and/or other penalties as outlined in this Policy. If the vehicle is returned after closing hours, you remain responsible for all loss of and damage to it until we inspect it at our next opening for business. Time, mileage and optional service charges will continue to accrue until our next opening for business. Any extension of the rental period must be agreed upon in writing by SuperCar prior to the original return date and time. Such an extension may be subject to additional terms and conditions as deemed necessary by SuperCar. We may require you to return the vehicle to our rental office for inspection prior to extending your rental. You must ensure that all personal belongings are removed from the vehicle prior to return, SuperCar is not responsible for any items left in the vehicle upon its return. You agree to return the vehicle to SuperCar in the same condition as it was received, except for ordinary wear and tear. The return location shall be the same as the pick-up location unless otherwise agreed in writing by SuperCar.

We may repossess the Vehicle at your expense without notice to you if the Vehicle is abandoned or used in violation of law or this Agreement. We may monitor the Vehicle through telematics devices to the extent permitted by law.

You agree to use the vehicle solely for personal transportation purposes within the state of Nevada, California, Arizona, Idaho, New York, Utah, Florida and Washington DC and not for any prohibited purposes. Prohibited purposes include but are not limited to, illegal activities, carrying a person or property for hire, speed tests, car exhibits, demonstrations, teaching purposes, driving on any unpaved surface, pushing or towing, carrying dangerous or hazardous items, racing, or business/commercial purposes without SuperCar's express written consent. You cannot use the vehicle to transport more people than the vehicle has seatbelts. If any seatbelt is inoperable, then contact us immediately. If the vehicle is a manual transmission and you lack experience driving a manual transmission, then it is your responsibility to inform us and surrender the vehicle. You must comply with all applicable laws, rules, and regulations of the state of Nevada, California, Arizona, Idaho, New York, Utah, Florida and Washington DC while operating the vehicle. You shall not operate the vehicle under the influence of alcohol, drugs, or any other substance that impairs driving ability, regardless of whether the substance is legal in the jurisdiction. You agree to wear a seat belt at all times while driving and ensure that all passengers do the same. You agree not to smoke or transport a pet or animal in the vehicle. You agree not to tamper with the odometer. You agree to comply with all applicable laws and regulations of the State of Nevada, California, Arizona, Idaho, New York, Utah, Florida and Washington DC and the Reservation Terms.

You shall not take the vehicle out of the state of the rental, unless a written exception is specifically provided in the rental agreement. For these purposes, rentals shall be limited to Nevada, California, Arizona, Idaho, New York, Utah, Florida and Washington DC.

The vehicle shall not be driven by any person other than the Renter or those authorized drivers listed in the rental agreement, unless prior written consent is obtained from us. The Renter is responsible for all tolls, fines, and penalties incurred during the rental period.

You are solely responsible for all parking, traffic, speeding or other tickets or violations issued while the vehicle is being rented and must pay for any fees, penalties, towing charges, or impound costs within twenty-four (24) hours of receiving notice of such charges.

You also are responsible for all tolls ("Tolls"), toll evasion fines, camera or parking citations, and other fines, fees and penalties ("Infractions") assessed against us or the Vehicle during this rental. Some toll roads do not accept cash payment, and you will incur additional fees if you travel on such a road without making alternative payment arrangements. If charging authorities notify us that we may be responsible for payment of a Toll or Infraction, you agree that we or a processing firm ("Processor") may, in SuperCar's sole discretion and without prior notice to you, pay the Toll or Infraction plus applicable taxes on your behalf directly to the authority. If we or a Processor elect to pay a Toll or Infraction, you may not be able to challenge the validity of the Toll or Infraction before the charging authority. We or the Processor will charge you the face value of the Toll or Infraction and any taxes, plus an administrative fee of up to $50 per Infraction and up to $25 per Toll. If we or a Processor elect to transfer liability for a Toll or Infraction assessed against the Vehicle during the Rental Period to you personally, we or the Processor will charge you an administrative fee of up to $50 per Infraction and up to $25 per Toll. You authorize us to release your rental and payment card information to the charging authorities and the Processor for processing and billing purposes. If we or the Processor pay a Toll or Infraction, you authorize us and the Processor to charge all payments and administrative fees to the payment card you used in connection with this Agreement.

You agree to maintain the rented vehicle in the same condition in which it was received, except for ordinary wear and tear. You shall not undertake any repairs or maintenance of the vehicle without the prior written consent of SuperCar. In the event of a mechanical failure or if the vehicle requires repairs, you must notify us immediately. Any unauthorized repairs or modifications made by you will be at your sole cost and expense, including the cost of reversing the repairs to SuperCar's satisfaction. You must check and maintain all fluid levels and return the Vehicle with at least the same amount of fuel as when rented unless you purchase pre-paid fuel. You agree to use the vehicle in a manner that does not subject it to excessive wear and tear. This includes, but is not limited to, avoiding: overloading the vehicle beyond manufacturer specifications, any off-road driving, aggressive driving (including rapid acceleration or hard braking), neglecting manufacturer recommended warm-up periods, excessive idling exceeding 10 minutes, frequent over-revving beyond redline, or storage in non-covered areas. Failure to comply with these conditions may result in additional charges. Should any mechanical issues arise during your rental period, you must notify SuperCar as soon as possible.

This policy shall be governed by and construed in accordance with the laws of the relevant rental state, which may include Nevada, California, Arizona, Idaho, New York, Utah, Florida and/or Washington D.C., without giving effect to any choice or conflict of law provisions or rules. The state and federal courts in Las Vegas, Nevada shall be the exclusive venue for all disputes arising hereunder.

In the event of any breach of these terms and conditions by you, we reserve the right to immediately cancel the rental agreement. Such a cancellation may subject you to additional charges, including but not limited to: (i) administrative fees not exceeding $500, (ii) actual damages resulting from early termination, and (iii) reasonable costs directly incurred by SuperCar as a result of the breach. All such charges will be itemized and provided to you in writing.

You are responsible for all injury, damage and loss to yourself or to others and their property resulting from use of the Vehicle during the rental, regardless of whether you are at fault. Damages include physical and mechanical damage; theft and vandalism; towing, storage and impound; and all costs associated with our enforcement of this Agreement or collection of charges, including attorneys' fees, collection fees, and costs whether or not litigation is commenced. You agree to maintain, at your own expense, a minimum of liability insurance coverage that meets or exceeds the statutory requirements of the State of Nevada. This insurance must cover bodily injury, property damage, and any other liability arising from the use of the rented vehicle. In the event of an accident or damage to the rented vehicle, you are required to notify SuperCar immediately and provide a detailed report of the incident, including any police reports or third-party claims. The Agreement is void if you breach this Agreement or fail to cooperate in a loss investigation by SuperCar or our insurer.

Your liability for damages to the rented vehicle is limited to the deductible amount unless the damage or loss is due to your negligence or violation of the Reservation Terms. In such cases, you may be held fully liable for all damages and associated costs. You shall be liable for indirect, incidental, or consequential damages arising from the use of the rented vehicle.

WE MAKE NO WARRANTIES, EXPRESS, IMPLIED OR APPARENT, REGARDING THE VEHICLE, NO WARRANTY OF MERCHANTABILITY AND NO WARRANTY THAT THE VEHICLE IS FIT FOR A PARTICULAR PURPOSE. We are not responsible for loss of or damage to personal property that was left with us or carried in or on the Vehicle, regardless of who is at fault.

By signing this agreement, you acknowledge you are taking the vehicle as is.

The Renter is fully responsible for all loss of or damage to the rented vehicle, regardless of fault, including repair, replacement, towing, storage, loss of use, and related costs. If the Renter purchases any third-party insurance or protection plan through an approved vendor of the Rental Agency, such coverage is a separate contract between the Renter and the insurer and does not limit or modify the Renter's liability under this Agreement. The Renter is advised to review all policy terms, conditions, deductibles, and exclusions carefully. The Renter hereby assigns to the Rental Agency all insurance proceeds payable for loss or damage to the vehicle, and the Rental Agency shall be named as loss payee on such policies. If the insurance is purchased through the Rental Agency's website or point-of-sale system, the Renter authorizes the Rental Agency to submit the insurance application on the Renter's behalf, and the Renter's signature on this Agreement shall constitute a signature on the insurance application and acceptance of its terms and conditions.

You agree to indemnify, defend, and hold harmless SuperCar and its affiliates, officers, directors, employees, and agents from and against any and all liabilities, claims, damages, losses, costs, fines, penalties, and expenses (including reasonable attorneys' fees) arising out of or related to your use and operation of the rented vehicle. This indemnification obligation includes, but is not limited to, any claims or demands made by third parties due to or arising out of your negligence, willful misconduct, or violation of any applicable laws or regulations. Your obligation to indemnify shall survive the termination or expiration of the rental agreement.

A waiver by us of any breach of this Policy is not a waiver of any additional breach or waiver of the performance of your obligations under this Policy. SuperCar's acceptance of payment from you or SuperCar's failure, refusal or neglect to exercise any of our rights under this Policy does not constitute a waiver of any other provision of this Policy. Unless prohibited by law, you release us from any liability for consequential, special or punitive damages in connection with this rental or reservation of a vehicle. If any provision of this Policy is deemed void or unenforceable, the remaining provisions are valid and enforceable.

You acknowledge and agree that renting and operating an exotic sports car involves inherent risks, including but not limited to, the increased potential for high-speed driving, accidents, traffic stops, and the unique handling characteristics of high-performance vehicles. By entering into this rental agreement and operating the vehicle, you expressly assume all risks associated with the use of the vehicle, including any injury, damage, or loss to yourself or others, arising from your operation of the exotic sports car. You acknowledge that you have the requisite skill, knowledge, and experience to safely operate such a vehicle and that you are voluntarily and knowingly accepting these risks. SuperCar shall not be liable for any injury, damage, or loss resulting from the operation of the vehicle, except as expressly provided by applicable law. You agree to indemnify and hold SuperCar harmless from any claims arising out of your assumption of these risks.

You acknowledge that the Vehicle may be equipped with a telematics system, global positioning satellite ("GPS") technology, an electronic locator device, and/or an event data recorder (collectively "Telematics System"). Your use of the Vehicle may be remotely monitored by us or on our behalf through a Telematics System to the extent permitted by law. Remote monitoring may include the collection of Vehicle data, such as location, odometer, oil life, fuel level, tire pressure, battery charge, diagnostic trouble codes, and other elements that we may deem necessary or desirable (to the extent permitted by law). You acknowledge that these systems may use cellular telephone, wireless technology, or radio signals to transmit data, and therefore you should have no expectation of privacy related to the use of this Vehicle. You shall inform any and all drivers and passengers of the Vehicle of the terms of this paragraph. We are not responsible for the operability of any Telematics System included with the Vehicle. To the extent permitted by law, you agree to release and indemnify, defend and hold us, the operator of the Telematics System, wireless carriers, and other suppliers of components or services harmless from any damage to persons or property caused by failure of a Telematics System to operate properly, or otherwise arising from the use of the Telematics System. Removing, tampering with or disabling a Vehicle telematics device or installing a telematics device in or on the Vehicle are also breaches of this Agreement.

If your Vehicle has active Telematics System equipment, you understand that your use of the Vehicle is subject to the third-party Telematics System operators terms and conditions, which may include system and service limitations, warranty exclusions, limitations of liability, and privacy practices relating to the collection, use, and sharing of information about you and the Vehicle. If the Vehicle does not have an active Telematics System, you agree not to activate it. If you do activate a service in violation of this Agreement, you will be responsible for all subscription fees.

We also reserve the right to use the Vehicle Telematics System in connection with your smart phone or other device to process the rental, including the start and end time, fuel levels, and mileage (to the extent permitted by law).

You acknowledge that SuperCar has established a Privacy Policy with respect to the use of personally identifiable data about individuals who are customers or prospective customers of the rental businesses of SuperCar and its subsidiaries. A full copy of the Privacy Policy may be viewed on our website. By providing us with personally identifiable data about you, you consent to the collection and use of data about you, subject only to any choices you are permitted to make to limit such use, and to your right to access and correct such data; you acknowledge data security risks and agree to take precautions to assist SuperCar in protecting such data; and you agree that SuperCar may make changes in the Privacy Policy in the future.

You agree that we may disclose your personal information to law enforcement agencies or other third parties in connection with enforcement of our rights under this Agreement or other legitimate purposes. Questions regarding privacy should be directed to the rental location. By providing your mobile phone number, you consent to receive SMS messages from us related to your rental. Message frequency may vary. Standard message and data rates may apply depending on your carrier. You may opt out of receiving SMS messages at any time by replying with "STOP" to any SMS message you receive from us. After opting out, you will receive a confirmation message, and we will cease sending SMS messages to your number. If you need assistance or have questions about our SMS service, reply with "HELP" to any SMS message you receive, or contact our customer support team at (888) 678-6077. Your phone number will be handled in accordance with our Privacy Policy. We do not share SMS opt-in consent with any third parties for solicitation purposes. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

This Agreement constitutes the entire agreement between you and us and cannot be modified except by a writing that we have signed. All prior representations and agreements between you and us regarding this rental are void. SuperCar's acceptance of payment from you or our failure, refusal or neglect to exercise our rights under this Agreement is not a waiver of any other provision of this Agreement.

When you sign, you initial each of these.

I, the undersigned Renter ("Renter"), authorize SuperCar Experience LLC ("Company") to charge the credit card provided for this reservation. I understand and agree that the card provided will be securely saved on file for future transactions associated with my account.

I understand and agree that any additional balances incurred during or after the rental period, including charges identified following the return of the rental vehicle, will be charged to the card on file.

I authorize the Company to process and capture any outstanding balance associated with my reservation in accordance with this authorization and my signature.

I certify that I am an authorized user of the credit card provided and agree not to dispute any transaction with my credit card issuer, provided such transaction corresponds to the terms outlined herein and/or the applicable Rental Agreement.

• Physical damage to the vehicle, whether discovered during or after the rental period
• Excess wear and tear, mechanical abuse, or misuse
• Smoking, odor, or ozone remediation fees
• Cleaning, detailing, or biohazard remediation fees
• Late return fees and additional rental days
• Mileage overages
• Fuel charges
• Traffic citations, tolls, parking violations, red-light or speed camera tickets, and related administrative fees
• Loss of use, diminished value, and administrative costs associated with damage
• Recovery, towing, impound, storage, or repossession fees
• Insurance deductibles or uncovered losses
• Any other charges, penalties, costs, or fees arising from Renter's breach of the Rental Agreement

This authorization shall survive termination of the Rental Agreement and return of the vehicle.

When you buy coverage through us, this contract is part of your agreement.

Renter has purchased physical damage coverage for the rented vehicle from SuperCar Experience LLC ("Company") for the rental period, for the coverage charge shown on this agreement. This coverage takes the place of Renter's own insurance for physical damage to the rented vehicle, subject to the deductible and the terms below.
